Introduction
These are the conditions that the Vendor agrees to while doing business with MobileKiDukan . Vendors will be listed on the website for the purpose of business generation on the basis of a membership and subscription.
WHEREAS:
- a) The Company has set up an online mall branded as 'Mobile Ki Dukan' at mobilekidukaan.in, which allows vendors to list mobile phones and accessories for potential customers to view and contact them directly.
- b) Vendors are independent businesses listed on the Marketplace to generate referrals, not employees or partners of the Company.
- c) Customers of the Marketplace are not consumers of the Company, but of the Vendors directly.
- d) Vendors can list their products on the Marketplace to promote their business and generate leads.
- e) A fee for membership and data maintenance will be charged to Vendors.
Terms Binding Upon the Vendors and the Marketplace:
1) Marketplace Usage:
Vendors will be treated as subscribers to the Marketplace and must adhere to the guidelines of product listing and lead generation. There is no direct selling on the platform.
2) Listing & Area-wise Proximity:
Vendors will be listed according to their proximity to the area selected by the viewer, and the viewer may contact the Vendor directly.
3) Vendor Subscription:
Vendors are subscribers and not employees of the Marketplace.
4) Competition:
- 4.1 Fair Pricing: Vendors must adhere to fair pricing, including offers. No underpricing or monopolistic practices are allowed.
- 4.2 Genuine Devices: All devices listed must be legitimate and include valid bills and warranties.
5) Maintenance:
- Annual subscription fee of Rs. 36,000/- (excluding GST).
- Vendors can list up to ____ devices (smartphones only).
- Image size should not exceed ___ MB, and vendors have ___ GB of allocated space.
6) Data Privacy:
The Marketplace will not share viewer data with Vendors unless specific conditions are met. Vendors are prohibited from sending bulk messages to viewers without consent.
7) False Endorsement:
Vendors are prohibited from claiming they are employees or representatives of the Marketplace to mislead customers.
8) Intellectual Property:
- 8.1: Vendors must use original images of their products and not source images from the internet.
- 8.2: Marks and logos of manufacturers should appear in plain text, without infringement of trademarks or copyrights.
- 8.3: Vendors cannot use the Marketplace’s logo without permission, except for advertising their shop.
9) Notices:
All official communication should be in writing and sent via email or registered post to the relevant parties.
10) Termination:
The Marketplace reserves the right to terminate the vendor’s subscription for any violation of these terms.
11) Disputes:
The Marketplace is not liable for any consumer disputes between Vendors and customers. Any disputes related to intellectual property infringement are also the responsibility of the Vendors.
